The Australian Environmental Labelling Association (AELA) terms and conditions for using and uploading products to the Australian Green Purchasing Database: Terms and conditions of Use 1. Your order and purchase is made on the basis of the terms outlined here in full. They may not be modified or altered in any way. 2. Your order and purchase are governed by the Laws of the Australian Capital Territory. Each party unconditionally submits to the jurisdiction of the Australian Capital Territory, Australia only. 3. You warrant that the details you provide for the purposes of this web site are correct. 4. If you are acting on behalf of a company or as an agent you warrant that you have actual authority to enter into this agreement. You indemnify all actions against AELA (the trading party for subscriptions to the green procurement database) if it is found that you do not have the required authority. 7. You agree to the cost, indicated as the subscription figure, in Australian Dollars (AUD) as is outlined in product submission pages internet site page. 8. Your selection of item/s that you have identified on the Upload new products facility is at law considered to be an invitation to treat. An offer is constituted, on the terms outlined in this statement, on the basis of your selection and the indicated total purchase price. Your acceptance will be indicated by you filling in your credit card details or forwarding payment in another form. By undertaking these actions you indicate your intention to accept these terms and conditions as part of your order and purchase. 9. Once your acceptance is communicated to AELA you will be required to complete the transaction by authorising AELA to debit your account according to the stipulated price in the Upload new products internet site page according to your organisations use of total number of unique product listings you generate. 10. Any taxes that apply to this transaction are those that would apply to the transaction as if it were conducted in the Australian Capital Territory, Australia. 11. AELA accepts no liability whatsoever for any loss whether caused directly or indirectly through the use of this web site or through contracting with AELA over the Internet. You agree to assume the full risk of contracting with AELA over the Internet and indemnify AELA for any and all losses you incur. 12. AELA accepts no liability whatsoever for any actions by third parties that interfere with this transaction. You acknowledge that technical difficulties may interfere with the operation of this transaction and assume this risk in accepting this offer. 13. If by reason of any fact or circumstance, matter or thing beyond the reasonable control of AELA or you as the purchaser, either is unable to perform in whole or in part any obligation under this agreement that party is relieved of that obligation under this agreement to the extent and for the period that it is so unable to perform and is not liable to the other party to this agreement in respect of such inability. 14. If any provision of these terms and conditions is deemed to be illegal, invalid, void or voidable, the validity of the remainder of the terms and conditions will not be affected and will continue to be in force and have effect. The right to change without notice any aspect of these Terms and Conditions is reserved.
